GENERAL TERMS AND CONDITIONS

ARTICLE 1 – PURPOSE

These General Terms and Conditions govern the rental of scooters and motorcycles carried out by TRIVIUM FAMILY SL, hereinafter referred to as THE LESSOR, to any natural or legal person, hereinafter referred to as THE LESSEE.

The signing of the rental agreement and/or the collection of the vehicle implies full and unconditional acceptance of these terms.

ARTICLE 3 – RENTAL REQUIREMENTS

To rent a vehicle, the Lessee must:

• Be of legal age.
• Present a valid identity document (ID card or passport).
• Hold a driving licence valid in Spain and appropriate for the rented vehicle.
• Meet the minimum driving licence seniority required for the vehicle.
• Provide a valid bank card for the security deposit.

The Lessor reserves the right to refuse any rental without providing justification.


ARTICLE 4 – RENTAL PERIOD

The rental is granted for the period specified in the rental agreement.

Any delay in returning the vehicle may result in additional charges according to the current rates.


ARTICLE 5 – PRICE AND PAYMENT

Prices are expressed in euros (€) and include mandatory insurance.

The full rental amount must be paid before the vehicle is handed over.

Additional charges may apply for:

• Missing fuel
• Damage or deterioration
• Extraordinary cleaning
• Fines and administrative fees
• Lost or damaged accessories


ARTICLE 6 – SECURITY DEPOSIT

A security deposit is required, the amount of which depends on the type of vehicle.

The deposit may be used to cover:

• Vehicle damage
• Theft or loss
• Fines and penalties
• Breach of contract

The deposit will be refunded after inspection of the vehicle, subject to any outstanding charges.


ARTICLE 7 – VEHICLE CONDITION

The vehicle is delivered in proper working condition.

The Lessee must check the vehicle’s condition before starting the rental.

Any damage not reported prior to departure shall be deemed the Lessee’s responsibility.


ARTICLE 8 – LESSEE’S OBLIGATIONS

The Lessee agrees to:

• Use the vehicle in compliance with applicable laws.
• Not sublet or allow third parties to use the vehicle.
• Not drive under the influence of alcohol, drugs, or prohibited substances.
• Wear an approved helmet at all times.
• Not leave the authorised territory.
• Not modify or tamper with the vehicle.


ARTICLE 9 – INSURANCE AND INCIDENTS

The vehicle is covered by mandatory insurance in accordance with Spanish law.

In the event of an accident, theft, or breakdown, the Lessee must:

• Inform the Lessor immediately.
• File a police report when required.
• Complete an accident report where applicable.

Any damage not covered by insurance shall be borne by the Lessee.


ARTICLE 10 – THEFT OR LOSS OF THE VEHICLE

In the event of theft or loss, the Lessee must:

• File a police report.
• Return the vehicle keys and documents.

Failure to comply will render the Lessee liable for the full value of the vehicle.


ARTICLE 11 – FINES AND OFFENCES

The Lessee is responsible for all fines and offences incurred during the rental period.

All fines and administrative costs will be charged to the Lessee.


ARTICLE 12 – RETURN OF THE VEHICLE

The vehicle must be returned:

• On the agreed date and time.
• With the same fuel level.
• In similar condition to that at delivery, normal wear and tear excepted.

Any breach may result in additional charges.


ARTICLE 13 – CANCELLATIONS

Cancellation charges may apply depending on the time of cancellation.

The booking deposit is refundable if cancellation is notified by email at least 5 days in advance, by replying to the booking confirmation email.

No refund will be issued in the event of a no-show or failure to present valid identification (passport or driving licence).


ARTICLE 14 – LIABILITY

The Lessor shall not be held responsible for personal belongings or indirect damages suffered by the Lessee.


ARTICLE 15 – APPLICABLE LAW AND JURISDICTION

These terms are governed by Spanish law.

Any dispute shall be submitted to the Courts and Tribunals of the Lessor’s registered office, unless mandatory law provides otherwise.
